Wrong-way accidents always raise serious red flags, particularly late in the evening on Memorial Day weekend. It’s often a glaring alarm that alcohol contributed to the accident. That makes it important to find out not just if a driver had been drinking but also how much and where the alcohol came from. Things are rarely as simple as just charging a drunk driver and moving on.
In Texas, alcohol providers can also be responsible for contributing to serious wrong way accidents. If a bar, restaurant, or similar establishment serves someone beyond the point of obvious intoxication, they can be held legally responsible for harm resulting from that intoxication.
Unfortunately, this too often slips through the cracks. I’ve handled hundreds of alcohol-related accident cases, and authorities often move on after investigating the crash scene. Meanwhile, there’s an accomplice continuing to put the community at risk, and it might take steps from the victims and families themselves to ensure someone holds them to account.
To be clear, this crash might not have involved alcohol. It’s simply a common factor that needs to be considered. But beyond that, investigations need to retrace the steps taken prior to the collision itself. A lot of the time, the mistakes that lead to a wrong-way driving crash happen long before that driver gets behind the wheel.
