Commentary by Attorney Michael Grossman
Obviously something went very wrong for a lift to fall like it reportedly did here, and it seems OSHA found things they believe are worth consequences. But even if that results in fines or administrative penalties, that doesn’t automatically get the worker’s loved ones the closure or resolution they deserve.
Simply put, Texas work fatality laws are more complex than in any other state in the country. There is not always a guarantee that families will receive benefits or see accountability after losing a loved one on the job. Even if OSHA finds violations, their focus is on their own administrative proceedings. They don’t go out of their way to arm families with the evidence and the legal tools needed to work toward their own resolution that best meets their needs.
So as concerning as the initial OSHA reports on this accident are, they’re likely just the tip of the iceberg. It wouldn’t be surprising if independent investigations into what happened revealed a far more complex story that simple fines or citations wouldn’t be enough to address on their own.
