Commentary by Attorney Michael Grossman

The fact that the victim in this crash was a passenger in a work vehicle raises all kinds of possible challenges for the victim’s loved ones. It’s important to anticipate those potential challenges early on.

On one hand, it could be that this all will fall within the scope of Texas work fatality law. Our state has the most complex work fatality laws of any other state in the country. There is not always a guaranteed path to getting families a fair resolution. There usually has to be a lengthy investigation and focused legal strategy to navigate the legal maze generally following a fatal work accident.

On the other hand, the victim may not have been working at the time, or the circumstances could be such that the path ahead is the same as any ordinary commercial vehicle accident. That, too, can involve its own challenges and hurdles. While the sort of evidence and legal tools required may be different, they can be just as complex as in a work-related accident.

Even in the unlikely event this involved other, less common areas of the law, the commonality will be the need for a careful and thorough accident reconstruction. People sometimes think an accident like this is just a typical car wreck, only bigger. The reality is they can bring up issues that a typical car accident investigation won’t be able to address. As such, authorities might not have the time, tools, or personnel to dedicate to getting answers for the victim’s loved ones. If that happens, there may need to be more thorough independent investigations before there can finally be some answers.
