Commentary by Attorney Michael Grossman
People tend to jump to conclusions when someone rear-ends another vehicle. It’s that old misconception that someone is automatically at fault for hitting the back of someone. That’s just not true.
The law is nuanced enough that it’s important to know why the collision happened. That could mean anything from distraction to road hazards to brake failure to issues with automatic driving systems. If there hasn’t been a careful accident reconstruction to rule out these possibilities, any sorts of conclusions are little more than speculation. It’s up to the evidence to say who or what is ultimately responsible for the accident.
