Commentary by Attorney Michael Grossman

When serious crashes between passenger vehicles and large trucks occur, many assume they’re just unfortunate incidents with little deeper cause. However, in my experience, these crashes rarely come down to simple luck or chance; they’re often the result of numerous factors that need to be carefully examined.

In a collision between a smaller vehicle and an 18-wheeler, one critical question is whether the truck was operating within safe parameters, especially in terms of speed and lane positioning. Large trucks have limited maneuverability and longer stopping distances, making even slight lapses in judgment potentially catastrophic. Investigators will need to look closely at whether each vehicle involved was able to see, react to, and avoid the other in the moments leading up to the crash.

If the 18-wheeler involved was operated by a commercial trucking company, it’s also worth investigating whether the company itself may bear some responsibility. Commercial trucking firms have a duty to keep their vehicles in safe, working order and to train drivers thoroughly in safe driving practices. Should investigators discover that poor vehicle maintenance, insufficient driver training, or even scheduling pressures contributed to the wreck, the company could be found at least partially responsible for what happened.

Ultimately, the goal is to uncover the truth and provide answers to those affected by the accident. Even if it requires conducting an independent investigation to obtain critical evidence, it’s essential to consider every factor to ensure that those impacted by the accident receive the clarity and closure they deserve.
