Commentary by Attorney Michael Grossman
Early morning accidents are complex enough on their own—as are commercial truck wrecks. Combining the two is no doubt going to present significant hurdles for those involved unless steps are being taken to have experienced accident reconstructionists preserve evidence early on. Authorities alone may not be thorough or quick enough.
Are investigators inspecting the vehicles for defects? Are they analyzing road conditions? Was lighting or signage an issue? Are they testing for drugs and alcohol? Are they securing cellphone records and data from the vehicles? Are they pulling video footage from any nearby cameras? Do they have witness information so they can follow up and put together a clear timeline of events?
While some of this information may seem obvious, it can take authorities a while to finally get to all of the important evidence. In the time that takes, important evidence could already be lost. It’s one of the reasons I always emphasize to people the need for prompt investigations to preserve evidence before it is lost, deleted, altered, or hidden. The more evidence folks have telling their side of the story, the better their outcomes will tend to be.
