Commentary by Attorney Michael Grossman
Considering the time of day, it wouldn’t be surprising if authorities were right that fatigue contributed to this accident. That said, commercial truck accidents aren’t just about what happened—they’re about why it happened. Let me give an example of what that looks like.
I had this case a while back where a truck driver caused a serious crash after being behind the wheel for over 20 hours straight. That alone was obviously reckless, and authorities felt content to end the investigations there. However, we kept digging. We found out that the driver’s employer set the stage for that crash to happen long before the driver got behind the wheel.
That company had a habit of pressuring drivers to meet ludicrous deadlines. If drivers didn’t cut all kinds of corners to meet those deadlines, they risked their livelihood. This predictably led to drivers breaking the rules to put food on the table. A devastating accident was all but inevitable.
Here’s why that matters. I’ve handled hundreds of commercial vehicle accident cases. Negligent companies generally clean up their act once they’re actually held accountable for their actions. Putting all the blame on a single driver without looking for the root cause allows the system to continue, and more people are likely to get hurt.
As such, going beyond just surface level details can help ensure both that there’s accountability for the victims and families as well as prevent future accidents. So, while it may seem like the cause of this crash is straight-forward, experience tells me there may be a lot more still behind the scenes that needs to be addressed.
