Commentary by Attorney Michael Grossman

When I hear about a crash where a vehicle left the roadway and struck a parked semi-truck, my first question is, “Why did the driver lose control?” Many people might assume this was just driver error, but in my experience, these kinds of crashes often involve multiple factors that need careful investigation.

The first thing investigators should determine is what caused the Toyota to leave the road. Did road conditions — such as debris, potholes or slick pavement — play a role? I’ve worked on cases where a seemingly random loss of control was actually caused by factors outside the driver’s control, such as tire failure or another vehicle cutting them off.

The severity of the crash and resulting fire also raise important questions. Was the impact force so great that it compromised the Toyota’s fuel system? I’ve seen cases where vehicle fires started because of design flaws that made fuel systems more vulnerable to rupture in high-speed collisions. Similarly, investigators should look at whether the truck’s underride guard functioned as designed or if the Toyota ended up partially under the trailer, which could indicate an equipment failure.

At this stage, there are too many unanswered questions to assume this was simply a matter of driver error. A thorough investigation should look at road conditions, possible mechanical failures and vehicle safety systems to ensure all contributing factors are fully understood. Without that level of scrutiny, the victim’s family may not get the answers they deserve about this crash.
