Commentary by Attorney Michael Grossman
When I hear about a crash where a semi-truck collides with an SUV at an intersection, my first question is, “Who had the right of way, and did both drivers have a clear view of each other before impact?” Many people assume that these crashes happen because one driver ignored a stop sign or signal, but in my experience, the reality is often more complicated.
One of the first things investigators should determine is how traffic was controlled at the intersection. Were there stop signs, traffic lights or yield signs in place? If so, did either driver fail to obey them, or was visibility an issue? Some intersections have poor sightlines due to trees, buildings or even the natural lay of the land. Investigators should assess whether anything may have obstructed either driver’s ability to see the other vehicle approaching.
Speed is another key factor. Was the semi-truck traveling too fast for conditions, or did the SUV misjudge the truck’s speed before entering the intersection? I’ve handled cases where a vehicle pulled out thinking it had enough time, only to be struck by a truck that was moving much faster than expected. Investigators should review ECM (black box) data from the truck to determine its speed before impact.
Beyond that, road conditions should be considered. Was the pavement dry, wet or icy? Were there any skid marks indicating braking, or did the collision happen without an attempt to stop? These details can help clarify whether one driver had time to react or if the crash was unavoidable due to external factors.
At this stage, too little is known to say exactly what caused this wreck, but that’s why a thorough investigation is necessary. Looking beyond the immediate crash scene — examining sightlines, vehicle speeds and road conditions — will be key in understanding what went wrong and whether anything could have been done differently to prevent it. The victims’ families deserve to know the answers to these questions.
