Commentary by Attorney Michael Grossman

When accidents like this happen, people often assume they are simply due to driver error. However, based on my experience, crashes involving large trucks frequently have more complex causes that require a thorough investigation.

This incident raises important questions about the circumstances leading up to the crash. For example, was the truck driver distracted or in a hurry? Were there any visibility issues that made it difficult for the truck driver to see oncoming traffic? These are critical factors that need to be examined to understand the full picture.

It’s important to consider whether factors such as driver fatigue played a role in this incident. Fatigue is a common issue in the trucking industry, especially when drivers are under pressure to meet tight deadlines. A fatigued driver may have slower reaction times or impaired judgment, increasing the likelihood of mistakes like failing to yield the right of way.

Additionally, the trucking company’s role in this incident should not be overlooked. If the truck involved was operating under a commercial entity, the company could bear responsibility for the driver’s actions. Companies are required to ensure that their drivers are adequately trained, that their vehicles are properly maintained, and that all safety protocols are followed. Any lapses in these areas could contribute to accidents like this one.

Ultimately, the goal is to uncover the truth and provide answers to those affected by the crash. Even if it requires conducting an independent investigation to obtain vital evidence, it is crucial to consider every factor to ensure that those impacted by the crash receive the clarity and closure they deserve.
