Authorities said a motorcycle was headed west when it crashed into a dump truck that was turning north onto 128th Street.

When a dump truck turns across the path of a motorcycle and a serious injury follows, the central legal question is one of timing and visibility; specifically, whether the truck driver executed the turn in a manner consistent with the heightened duty of care expected of commercial operators. Motorcyclists are already at a disadvantage when it comes to protection and visibility. That’s exactly why the law places such a strong burden on commercial drivers to confirm the path is clear before making a turn.

At intersections like Capitol Drive and 128th Street, which are often busy with mixed traffic, trucks making a left or crossing turn must account for the speed and position of every vehicle in the oncoming lane. With motorcycles, that calculation becomes even more critical. They’re harder to see, but that doesn’t reduce the driver’s responsibility to see them. It increases the need to pause, look again and wait for a clear, unambiguous opportunity to complete the maneuver.

If the truck turned while the motorcycle had the right of way, or misjudged the rider’s speed or distance, that points to a preventable error. Even if the rider was traveling at or slightly above the posted limit, commercial drivers are trained to expect exactly that kind of variable when making left-hand or cross-street turns. That’s part of the job.

Ultimately, this crash isn’t about who had the bigger vehicle. It’s about who had the legal responsibility to ensure the intersection was safe to cross.
