My concern here isn’t that we in the public don’t have any clear answers about what went wrong. My concern is that a lack of public information like this is sometimes a reflection of how much information the family is getting behind the scenes. It would shock people how many Texas work fatality cases I’ve handled where authorities never answered any of a family’s questions, leaving the family to seek out answers on their own.

Ultimately, though, OSHA does not exist to get clarity for a worker’s loved ones. They also aren’t usually focused on giving families a clear path through the legal maze that is Texas work fatality law. Instead, they prioritize their own goals of finding violations and issuing appropriate fines. Anything more than that usually comes down to families seeking out independent investigations and professionals experienced with Texas work accident law.

It’s possible officials worked behind the scenes here to ensure the victim’s loved ones got all the answers they deserve. If they didn’t, though, that unfortunately wouldn’t be unusual.
