Commentary by Attorney Michael Grossman

With crashes like this, folks sometimes think investigations are open-and-shut. If a medical emergency led to the crash, what more is there to investigate? Well, the cause of the crash and the cause of a victim’s injuries aren’t always the same.

For example, did authorities have an independent professional analyze how the vehicle held up in the rollover? Something that doesn’t get much attention is how some manufacturers design or construct vehicles such that they too easily get crushed in a rollover. Other, safer manufacturers’ vehicles can hold up in a crash and protect the driver. Meanwhile, a driver in a vehicle that is poorly built ends up suffering serious or fatal injuries that were entirely preventable.

Common or not, this sort of thing happens, and it’s important to include that possibility in any accident reconstruction. But if authorities were too focused on one possible explanation, they may have overlooked other important details.
