Commentary by Attorney Michael Grossman
There are two things that immediately come to mind reading these details. Firstly, did authorities download and independently preserve the video evidence of this accident? There is a huge difference between a family having direct access to crucial video evidence of an accident and an officer simply testifying that they saw the video. Security footage is routinely deleted or overwritten, which is why making sure it is preserved is so crucial.
Secondly, a driver being cited or charged doesn’t always resolve everything. I’ve handled hundreds of commercial vehicle accident cases, and one driver’s mistake is often the result of issues that happened long before they got behind the wheel.
Was that driver on their phone with a supervisor or colleague? Were they fatigued after working long hours? Did improper training or inexperience contribute to the crash? Does the driver have a history of reckless driving? Were they being inpatient and rushing to meet an unreasonable deadline?
Not only do families deserve to see accountability after the loss of a loved one, but they also deserve to know other families won’t be harmed in the future. So as important as it is to address a truck driver’s mistakes, it’s equally if not more important to know if that mistake was actually just a symptom of the real problem behind the scenes.
