Commentary by Attorney Michael Grossman

In their investigations authorities said that alcohol was a possible factor in the accident. If that’s true, it would obviously be concerning for a minor to have been drinking. That would make it important to find out where that alcohol came from. In Texas, someone who provides alcohol to a minor can be liable if it contributes to an accident. That could be a family member or older acquaintance, or it could even be a local business selling alcohol to minors. In my experience confronting hundreds of negligent alcohol providers, an establishment serving minors is likely to be breaking all kinds of other laws. So if authorities here didn’t extend their investigations beyond the crash scene, they could be missing something important.
