Commentary by Attorney Michael Grossman
One of my concerns with accidents like this is people often see bicyclists and just jump to conclusions. But like any fatal accident, it’s important to let the evidence speak for itself. Things like right-of-way may be important, but they’re just one part of the story.
What speeds were the vehicles going? What condition was the road in? Is there a lack of signage or road markings here? Was distraction a factor? Have authorities secured cell phone records from all involved? Are there any nearby residences or businesses that may have captured the incident on video?
At the end of the day, there’s a family out there that deserves answers. In my experience, it’s not enough to just land on the obvious or easy explanation. It’s important to be able to say confidently the family is getting the complete story, whatever that may be.
