Commentary by Attorney Michael Grossman
A common mistake I see a lot is that when authorities blame someone for an accident, that means everything is open-and-shut. After any serious car accident, though, it’s important to ensure the victims and families involved have all the facts. Preliminary police investigations don’t always provide that on their own.
When it comes to complex factors—vehicle inspections, electronic data, video evidence, road conditions and intersection design, etc.—it often takes more thorough independent accident reconstructions to gather and preserve evidence. If authorities had the time and equipment to do that here, that’s good. However, it would be far from the first time a seemingly simple crash needed another set of eyes looking things over to make sure nothing important slipped through the cracks.
