Commentary by Attorney Michael Grossman

I’ve said a million times on this blog that it’s a misconception that someone who hits the back of another vehicle is automatically responsible for a crash. However, generally speaking, it usually is true. That’s because things like distraction, unsafe speeds, and following too closely are very common. But like any crash, it’s important to let the evidence speak for itself. Likely or not, all factors warrant attention to make sure nothing important slips through the cracks. If something unusual did lead to this crash, it shouldn’t go overlooked just because no one thought to consider less common factors. Hopefully authorities are approaching their investigations with a similar thought.
