When someone suffers serious injuries in a rollover crash like the one recently reported in New Caney, it’s tempting to accept the initial report as the whole story. But in my 30-plus years handling motor vehicle accident cases throughout Texas, I’ve seen just how often early assumptions fall apart under real scrutiny. Getting the truth means going beyond the surface and asking the right questions.
Did law enforcement conduct a thorough investigation of the scene? Single-vehicle rollovers can be complex events influenced by far more than driver behavior alone. Questions need to be asked about the roadway—was there a defect, obstruction, or unsafe curve that contributed to the crash? Was visibility an issue or was signage unclear? If these angles weren’t fully explored, the investigation may be incomplete.
Was the vehicle itself inspected for mechanical defects? Problems like tire failure, suspension issues, or steering malfunctions can turn a manageable situation into a catastrophic one. Rollovers in particular often raise questions about vehicle stability and crashworthiness. If the vehicle has since been moved or repaired, valuable evidence may already be lost unless steps were taken to preserve it.
Has the vehicle’s electronic data been recovered and reviewed? Many newer vehicles contain electronic data recorders that can provide a detailed account of a driver’s actions and the vehicle’s performance in the moments leading up to a crash. This kind of information can help confirm or refute assumptions and clarify whether this incident was caused by human error, mechanical failure, or something else entirely.
Answering these three questions is critical to making sure that no stone is left unturned in understanding the causes of a crash like this. Serious wrecks deserve serious investigation, not assumptions. Getting clear answers to these questions is crucial for those seeking to understand what happened and why—and it’s the least that can be done to help those affected find the clarity and closure they deserve.
