Commentary by Attorney Michael Grossman

Authorities alleged that the driver of the vehicle was under the influence of alcohol at the time, and they recommended charges. Folks tend to think that’s where investigations stop, but those charges don’t really do much for the victims. That’s why it’s also important to know where the alcohol came from.

In Texas, if an alcohol provider negligently over-serves someone who then causes an accident due to their intoxication, the provider can be responsible for their role in the resulting injuries. Not only is this a possible avenue to get victims the help they need, it’s also a way to see those negligent alcohol providers are held accountable for breaking the law. Maybe nothing like that would apply to this particular accident, but it’s important to make sure there is clear evidence one way or the other.
