Lubbock, TX — December 23, 2024, Shon Rushmore was killed as the result of a work accident at around 7:30 a.m. along East 34th Street.

OSHA released a preliminary accident summary, saying the incident took place near the intersection of Globe Avenue, between Avenue A and MLK Jr. Boulevard.

According to officials, 47-year-old Shon Rushmore was working near a loader at the time when that loader struck Shon Rushmore. As a result, Shon Rushmore was killed. There did not appear to be any other injuries.

The OSHA inspection summary listed an alleged violation citation as well as a recommended penalty. Additional details are unavailable at this time.

Something to note about any fatal work accident in Texas is that our work fatality laws are uniquely complex. There isn’t always a guaranteed path for a worker’s loved ones following an accident. As such, the burden of looking for a resolution and even for seeing accountability can fall on their shoulders. Even when OSHA goes through their process, that may just be the tip of the iceberg.

So when I read these statements, my thought isn’t to consider the matter resolved simply because OSHA alleged there was a violation here. My thought is if steps were taken beyond those OSHA investigations to consider the needs of the worker’s family and what paths were available to them.
