If it’s true that the at fault driver here had been drinking, then people may just see all of this as open-and-shut. But investigations into alcohol-related accidents, when done properly, are far from simple. This is because a proper investigation has to address both the drunk driver and any alcohol provider that may have over-served them. In Texas, it’s illegal for an alcohol provider such as a bar or restaurant to over-serve someone who is obviously intoxicated. Authorities can investigate those negligent alcohol providers, but they often let that detail slip through the cracks.
For example, I handled a case not long ago where a drunk driver drove into oncoming traffic and hit a family head-on. After they contacted us, we started digging into where the alcohol came from. It turned out the man was at a local bar where he became extremely intoxicated. The servers kept serving the man even when he could barely walk to the bathroom without almost falling on his face. It was clear they broke the law, yet authorities never bothered investigating anything beyond the crash scene. They had their drunk driver facing charges, and it was good enough for them. Meanwhile, had it not been for the family seeking out independent opinions, that negligent alcohol provider likely would have just continued being a danger to the community rather than facing consequences for their actions.
That’s why I try to shine a light on accidents like this. As common as drunk driving is, these accidents don’t often get the actual attention they need from authorities. By talking about these potential legal avenues as much as possible, more people will know how to ensure authorities are actually giving their accident the attention it deserves and what other options may be available if they’re not.
