Commentary by Attorney Michael Grossman

At this time, exact factors leading to the crash are unclear. However, in the 30 years I’ve been handling commercial truck accident cases, I can’t recall a time where a truck failed to stop for any reason other than someone making a mistake. That may seem obvious enough, but it’s important to know not just what the mistake was but why it happened.

Here’s what I mean by that. Many of the hundreds of truck accident cases I’ve handled involved employers whose negligent business practices predictably led to a serious crash. Any experienced trucker can attest some companies out there only care about speed and production, foregoing things like basic training, regular maintenance, background checks, and otherwise encouraging drivers to cut corners so they can meet unreasonable deadlines. Inevitably, this leads to truck drivers making mistakes they might not otherwise if they worked for a company that cared about safety.

Ultimately, the biggest risk to responsible truck drivers is irresponsible truck drivers giving their profession a bad name. As long as there are companies hiring those drivers or encouraging that behavior, these accidents will continue to happen. At the very least, there should be steps to make sure all parties responsible for these crashes are held accountable for their actions.
