Commentary by Attorney Michael Grossman

The challenge with crashes like this often comes back to the fact the victim isn’t around to tell their side of the story. It’s reasonable, then, that families want to be sure they’re getting all the facts. That’s not always something authorities guarantee.

For example, one of the first things I look into after single-vehicle accidents is electronic evidence. Did authorities pull cellphone records? Did they secure data from the victim’s Engine Control Module? Are there nearby businesses or residences that had a security camera catch the incident on video? This information tends to be time-sensitive, so authorities might miss crucial information if they drag their feet or fail to consider electronic evidence altogether.

It’s possible authorities here have been thorough and will be able to provide a clear picture of what led to this crash. But if following up with them shows they left a lot of key electronic evidence slip through the cracks, it could be a sign they’re overlooking other important factors, as well.
