Commentary by Attorney Michael Grossman

The driver involved in this wreck was allegedly under the influence of alcohol. If that’s true, have authorities looked into whether or not the driver was unlawfully over-served? Here’s why that matters.

In Texas, alcohol providers who unlawfully over-serve someone that is obviously intoxicated, they can face criminal investigations, fines, license suspension, and liability when people get hurt. But when authorities only focus on the crash scene, those negligent alcohol providers can slip through the cracks. Simply put, it’s just as important to put those negligent alcohol providers on the straight-and-narrow as it is to see drunk drivers have their day in court. So if authorities aren’t taking the steps to hold an alcohol provider accountable for their role in a serious accident, it’s usually up to the victims and families involved to make sure someone picks up the slack.
