How Did This Accident Occur?

There simply isn’t enough information to say what happened in this specific accident. A lot of people, however, think work accidents just involve the victims making a mistake, and then OSHA and workers’ comp takes care of everything from there. In my experience, things are rarely ever that simple.

First of all, there are plenty of things that workers have no control over which can lead to their deaths. Equipment that is worn and needs to be replaced, supervisors not providing safety equipment, hazardous conditions of structures on the site, mistakes from workers employed by other companies working on the same job site, negligent co-workers who aren’t properly trained or vetted, etc.

Not only that, but when accidents do happen, there isn’t always an automatic process for making things right for workers and their families. Texas has the most complex work fatality laws in the whole country. Sometimes, it’s up to the victims and families to navigate a legal maze and advocate for a fair resolution themselves. If they don’t have experienced allies working to help them get through all that legal mess, things can become overwhelming.

That’s why fatal work accidents tend to have better outcomes when they get attention from experienced professionals as soon as possible. The more evidence families have telling their story, and the more legal tools and strategies they have working in their favor, the easier it will be to overcome the numerous inherent obstacles surrounding Texas fatal work accidents. Hopefully those steps are being taken here.
