Commentary by Attorney Michael Grossman

While the cause of the crash isn’t confirmed right now, some may already be jumping to conclusions. When younger drivers are involved in a crash, folks tend to just assume they were speeding, on their phone, or otherwise being reckless. Is that possible? Of course—younger drivers are statistically more likely to cause accidents. But there are always other important possible factors to consider.

Was there a mechanical issue? Did the vehicle have a defect? Did a tire blowout? Was there something in the road? Does this roadway have accidents frequently? Did a medical condition play a role? When I ask these questions, and the drivers are older, people don’t really have an issue. When the drivers are younger, though, all prudence goes out the window. Not only is that irresponsible, it’s just plain disrespectful to the victims and families involved. They deserve to know the investigations into their accident are being handled as carefully as any other complex accident. Otherwise, there’s no telling what might slip through the cracks. It just remains to be seen if authorities handling this accident kept that in mind or if they, too, let a negative bias cloud their judgment.
