Commentary by Attorney Michael Grossman

When reading about a truck rollover accident, people are often quick to move on. They tend to assume that everything falls within work fatality laws, and that means there’s some automatic process for resolving things. But when there’s a passenger involved, things aren’t always that simple. Things can vary significantly depending on who the passenger is and why they were in the truck.

To sum things up, if a passenger isn’t a co-worker, the avenues available to them or their family are essentially the same as if they were in a separate vehicle hit by a semi-truck. Whether that’s a friend, family member, or just some acquaintance along for the ride, they have the same rights as any ordinary individual would hurt in an 18-wheeler accident.

So while it’s not clear what exactly led to this crash, it is clear that the path forward is likely complex. That means there needs to be prompt and thorough investigations from well-equipped professionals so that nothing important slips through the cracks. Getting answers for a grieving family is important enough on its own. Making sure a victim understands what options are available to them is an entirely separate challenge.
