Commentary by Attorney Michael Grossman

A challenge with car accidents few consider is that the cause of a crash and the cause of someone’s injuries are not always the same. Why do I bring this up? Well, folks may see a crash caused by a deer and just assume there’s nothing more to discuss—it’s not like you can hold a deer accountable. But if authorities don’t closely examine things, they may overlook other extenuating circumstances.

For example, I handled a case not long ago where authorities completely failed to notice someone’s seatbelt had a defect. In that crash, the victim wore their seatbelt properly, but the pretensioner failed. It caused them to be thrown from their seat despite properly using their seatbelt, meaning their serious injuries would have been prevented had it not been for the defect.

So while I certainly can’t say I know anything about this crash beyond what’s been released publicly, I have to wonder if authorities ever took the proper steps to ensure nothing unusual like that slipped through the cracks.
