Commentary by Attorney Michael Grossman

Despite doing this job for over 30 years, still to this day one of the most common misconceptions I see is people thinking someone is automatically at-fault for rear-ending another vehicle. That’s just not true. There are no magic equations in Texas law about rear-end collisions. As always, the context matters. Was someone on their phone? Was there a sudden lane change? Was alcohol a factor? Was there a disabled vehicle in the road? Did either vehicle experience mechanical issues? Getting to the heart of the matter means letting the evidence speak for itself. Jumping to conclusions doesn’t help anyone.
