Commentary by Attorney Michael Grossman

Seeing that this accident involved a lone vehicle, I can’t help but feel a little concerned. In my experience single-vehicle crashes aren’t always treated with an open mind or appropriate care by the public, or even in some cases by authorities. Folks are quick to assume the driver did something wrong even though there are many reasons a vehicle can lose control—some of which would have been wholly out of the victim’s hands. Could something have punctured a tire on the car? Could it have had a mechanical failure or defect that sent it off-course? Was the driver incapacitated somehow? Is it possible another vehicle ran her out of her lane but left the scene? What story does the “black box” data from the car tell? What about her phone? Will anyone check?

I’m not suggesting that careful investigation would reveal anything shocking; I just think accident victims deserve nothing less than maximum effort. That means carefully looking into every possibility, even less-likely ones, if only to rule them out. Police investigations don’t always get that detailed, as there are always more demands on their time. If the victim’s loved ones want to be sure they have the whole story, who will help them get it?
