Commentary by Attorney Michael Grossman

People tend to overlook work accidents like this because they assume OSHA does all the work behind the scenes to get the family answers and see they have a path to a just resolution. In reality, OSHA rarely does anything beyond their own effort to look for violations and issue citations. Families more often have to look for independent investigators to get answers after a deadly work accident. Not only that, but there isn’t always a guarantee that families will receive benefits following a worker’s death. It can sometimes require navigating what is the country’s most complex work fatality laws, and that’s not something OSHA gets involved in. So while I hope steps have been taken here to get answers and help for this man’s loved ones, that’s not something anyone should take for granted.
