How Did This Accident Occur?

At first glance, it looks like this accident is a cut and dried case of a bicyclist failing to yield to a vehicle as it was crossing the road. However, it could be that there is more to the story than that. I’m not saying I know more than anyone else about this accident, specifically. I’m just suggesting some hypotheticals based on bicycle versus car accidents that I’ve analyzed in the past.

First of all, the accident took place late in the evening. Was there sufficient street lighting at the intersection? If there were street lamps, were they all functioning? Second, were the headlights of the motor vehicle on? If it were driving on the roadway without its lights on then that would make it much more difficult to be seen by the bike rider. Third, were the brakes and steering working properly? Did the driver attempt to avoid a collision with the biker but end up being unable due to a mechanical malfunction or product defect?

I hope the authorities in charge of investigating this accident are being open-minded and thorough enough to answer all these questions. If they are somehow lacking, a third party investigator can always step in to take up their slack. After all, the victim’s loved ones deserve to know and understand the details and have hard evidence to back them up. It’s not enough for them to be handed vague excuses that heap an unfair amount of blame on the shoulders of the deceased.
