Odessa, TX — March 29, 2024, Rigoberto Rios was killed as the result of a work accident at around 4:53 p.m. off South County Road West.

Preliminary information about the accident says that it happened along the 3200 block of South County Road West.

According to officials, 23-year-old Rigoberto Rios was moving traffic cones at the time. While doing so, a trailer struck Rigoberto Rios. As a result, Rigoberto Rios was killed.

OSHA listed two alleged violation citations in their initial statements. No further information is available at this time.

Accidents like this can be far more complex than folks may realize. For one, a lot depends on if the worker was killed by a co-worker or someone from a separate company. While work accident law can still apply in the latter scenario, a worker killed by someone from another company can proceed much like a typical 18-wheeler traffic accident.

Otherwise, if this all was within the scope of a work accident, that alone can also present unique challenges. Texas has the most complex work fatality laws in the whole country. Without the right evidence and legal tools, that can prove to be a legal maze. So regardless of what happened here, my hope is steps were taken early on to prepare the victim’s family accordingly.
