Commentary by Attorney Michael Grossman

It’s obviously concerning when OSHA looks into a workplace fatality and alleges there were serious violations. However, OSHA efforts often just scratch the surface. Texas fatal work accident law is more complex than in any other state in the country. As such, workers’ families need as much evidence surrounding the accident as possible, and they need to be able to navigate the legal maze that stands between them and a fair resolution. OSHA reports alone are rarely enough to do that. They may help, but they often have to work in conjunction with independent investigations and allies experienced with Texas work fatality law. Hopefully that happened here.
