Commentary by Attorney Michael Grossman

There’s no telling exactly what happened here yet, and I tend to discourage too much speculation while the facts are still coming in. Some people quickly decide someone was distracted, speeding, intoxicated, or some combination of those after reading about a mysterious loss of control, yet in many cases it’s eventually learned that something else entirely—something out of anyone’s hands—was to blame. Some things are rarer than others, but they still cause plenty of accidents every day. Wet roads, vehicle malfunctions, blown tires, medical emergencies, and other possibilities must be considered and investigated in order to be sure the whole truth is found.

Consider as an example the General Motors “ignition switch” recalls a few years back. In case you missed it or don’t recall, a lot of people crashed their GM and Chevy vehicles because those cars shut down while in motion. A defective part spread across millions of vehicles caused over a hundred traffic deaths and countless more injuries, but a lot of the drivers who couldn’t help but crash got called drunk or careless before the truth finally came out. That’s why I always call for careful and thorough investigations—to put the blame where it really belongs.

In the end the Odessa wreck might have a simple explanation, but the driver who lost control deserves the benefit of the doubt until clear facts and evidence can tell the whole story. I just hope authorities plan to find those facts and put the puzzle together right.
