Peggy Michelle Rickman Injured in Truck Accident in Bastrop County, TX

Authorities said in their statements that 72-year-old Peggy Michelle Rickman was in a Toyota Highlander that was going eastbound on the U.S. 290 service road approaching the light at Highway 21. It appears witnesses testified and video footage showed that the Toyota passed multiple vehicles stopped at a red light and entered southbound lanes where a tractor-trailer crashed into it. Rickman was taken from the scene with apparently incapacitating injuries.

Commentary by Attorney Michael Grossman

My hope is people aren’t seeing the allegations the victim’s car went through a red light and immediately using that to blame the victim. To be clear, I don’t know more than the public information provided here. But I’ve had plenty of folks call our firm after a serious truck wreck with similar details, and it turned out authorities never got their side of the story.

A vehicle going through a red light is always bad, but it’s not always the result of a mistake. There may have been a medical emergency, for example. It’s also possible something like a mechanical defect contributed to the crash. If authorities simply go with what they feel is a likely explanation without considering other possibilities, they can easily overlook something important. Were they ever able to verify what actually happened here and whether or not it was avoidable?
