Commentary by Attorney Michael Grossman
When people see authorities accuse a pedestrian of doing something wrong, that’s generally when they move on from a story like this. If authorities say the pedestrian was jaywalking, that’s the end of the story, right? Well, the law is more nuanced than that.
Let’s consider a hypothetical where a pedestrian is crossing the middle of a roadway, but they’re clearly visible and far away enough that a reasonably prudent driver should be able to avoid them. Would a driver have free rein to run over the pedestrian simply because they have the right-of-way? Obviously not. As such, if evidence shows that a driver failed to avoid an otherwise avoidable collision, right-of-way or not, it’s important to find out what prevented them from avoiding the accident.
To be clear, I’m not saying anything about whether or not this accident was avoidable. I just wanted to shine a light on the fact that an accident like this isn’t necessarily open-and-shut like people may think. There should still be consideration for the evidence, and that likely requires more thorough investigations.
