Commentary by Attorney Michael Grossman

Right now, the cause of the accident is unconfirmed, and authorities do not report any charges or citations. They said that they were investigating if the driver may have been intoxicated at the time.

What I’m wondering is if authorities saying they’re investigating intoxication is due to simple standard procedure or actual suspicion of intoxicated driving. Drunk driving is so common in Texas that it could really go either way.

If alcohol was a factor here, I would hope to see authorities also find out if the driver was illegally over-served by a local bar. Too often, I get calls from families about crashes where authorities took every step to address the possibility of an intoxicated driver, but when they found alcohol, they never bothered finding out where the alcohol came from and if that provider was putting other lives at risk.

Whether or not something like intoxicated driving was a factor here, any crash resulting in serious injuries is worth looking into thoroughly. Even if something seems unlikely, those affected by the accident need to feel certain they’re getting all the facts.
