Commentary by Attorney Michael Grossman

A common misconception I see is people think pedestrian accidents are all about right-of-way. Either the pedestrian was in a crosswalk, or they were at fault. The law simply isn’t that cut-and-dry. It’s always important to know the full context.

A reckless driver, for example, wouldn’t automatically get a free pass just because someone wasn’t in a crosswalk. Ultimately, it’s about how the accident could have been avoided, and whose actions were more likely than not the cause of the victim’s injuries. Short of that, investigations should be considered incomplete until more facts are brought to light.
