People sometimes assume pedestrian accidents all come down to who had the right-of-way. Things aren’t always so simple. After all, in an example where a driver is being reckless, and they fail to avoid someone who is clearly visible and avoidable, they wouldn’t get a free pass just because someone wasn’t in a crosswalk. I’m not saying that happened here, but investigations need to be able to consider that if they’re going to get a complete picture of what went wrong.
