Commentary by Attorney Michael Grossman
People sometimes view pedestrian accidents are simple. Either the victim was in a crosswalk, or they weren’t. Right? Well, the law just isn’t that simple. It’s important to know the full context, including how avoidable the collision was. If a driver could have seen and avoided the victim, it’s important to find out why this driver didn’t. If details show there was no reasonable way to avoid the pedestrian, then it wouldn’t be reasonable for the driver to be held responsible. All that depends on more details that these initial statements currently lack.
