Commentary by Attorney Michael Grossman
One of my concerns with any pedestrian accident is if it’s getting the attention it needs. Unfortunately, not a lot of people wait for the facts in these situations. Many just assume that either the pedestrian was in a crosswalk, or they were in the wrong. Simply put, the law is more nuanced than that. It’s important to know how avoidable the accident it was and what factors ultimately led to it. That takes a proper investigation, and if steps haven’t been taken to gather as much clear evidence as possible, then the investigations should be considered final.
