Commentary by Attorney Michael Grossman
People often think pedestrian accidents are simple and all come down to who had the right-of-way. The reality is it usually comes down to whether or not the collision was avoidable. A driver texting and driving, for example, might not be in the clear just because someone wasn’t using a crosswalk. How exactly this all played out will be up to more thorough investigations to say for certain.
