Commentary by Attorney Michael Grossman

As open-and-shut as these details seem, it’s always important to make sure authorities actually preserved evidence to back up their reports. I’ve had cases where authorities blamed distracted driving, but it turned out they never went through the courts to actually subpoena the phone records to back up that claim. This is especially a concern with pedestrian accidents, which too often slip through the cracks. Hopefully authorities here took the time to actually preserve the evidence those involved in the crash will need going forward.
