Commentary by Attorney Michael Grossman
Getting to the bottom of what led to this accident is sure to be challenging enough on its own. However, what comes next for a worker’s family is just as important to consider. In Texas, that path is more complex than in any other state in the country.
Put simply, Texas work fatality law is uniquely challenging. We’re the only state where employers are not required to subscribe to a workers’ comp system. That means some families are at the mercy of their loved one’s employer. In my experience, employers are usually going to put their own needs before the needs of a worker’s family. Ensuring that process is fair takes a lot of evidence and experience dealing with potentially combative employers.
On top of that, even when an accident does fall within the scope of the workers’ comp system, Texas law says there are some situations where an employer’s actions are especially egregious. As such, they may call for consequences on top of solutions that workers’ comp provides. This is called gross negligence, and it’s about as far from straight-forward as a work fatality can get.
Regardless of what leads to a fatal work accident, there is almost always a legal maze families are left to navigate. That maze requires ample evidence, legal strategy, and prompt action to get through. So as steps are taken here to find out what led to a worker losing their life, it would be equally prudent to look into what path lies ahead for the worker’s loved ones.
