The SUV driver, 32, was charged with driving while impaired, authorities said. He has a prior DWI conviction.

How Did This Accident Occur?

I expect authorities to investigate this crash like any other, but they also should spend some time looking into the driver’s movements before the crash if blood tests confirm he was intoxicated. Where he had been drinking matters.

It’s one thing if he had been drinking at home, but if he had been at a bar or restaurant that establishment could share responsibility for injuries caused in this crash. Under Texas law, alcohol providers are not supposed to serve someone who is obviously intoxicated. If they do and that patron decides to get behind the wheel, they can be accountable for any injuries caused by the patron.

I don’t know if that is what happened in this instance, but it is worth investigating so the injured pedestrian and her family will know everyone who may have played a role in this crash.
