Commentary by Attorney Michael Grossman
When I read about incidents like this one, what stands out to me isn’t just what happened, but what’s missing from the conversation; namely, how a driver became so impaired that someone walking nearby was seriously hurt. The law rightly holds intoxicated drivers accountable, but it’s also worth asking whether someone else may have contributed to the danger by serving that driver alcohol when they shouldn’t have.
One of the most important but often overlooked questions in cases like this is, “Where did the driver get their alcohol?” If the driver was overserved at a bar, restaurant or other licensed establishment, Texas law allows the injured party to pursue accountability not just from the driver, but also from any alcohol provider that contributed to the crash by serving someone who was clearly intoxicated.
This kind of incident reminds us that drunk driving doesn’t happen in a vacuum. Overservice is a real and preventable problem; and while it’s easy to focus only on the individual behind the wheel, public safety also depends on responsible alcohol service. The law recognizes this, and in the right circumstances, it gives victims the tools to hold all responsible parties accountable.
Key Takeaways:
- Texas dram shop law allows victims to hold alcohol providers accountable when they serve obviously intoxicated patrons who go on to cause harm.
- It’s important to investigate not just the crash, but where the driver had been drinking and whether overservice played a role.
- Many people don’t realize they have legal options after a drunk driving crash, especially when it comes to alcohol provider liability.
