Commentary by Attorney Michael Grossman
At the heart of any fatal work accident is a family trying to understand how and why their loved one never came home. In Texas, finding those answers is not automatic, even when an investigation confirms there were problems at the job site. Making sure families get clear information, accountability where appropriate, and a fair resolution often requires a lot more than an OSHA investigation. As such, this lack of information isn’t entirely surprising for me. Most every fatal work accident case I’ve handled had similar OSHA statements which left all sorts of blanks that needed independent investigations to fill in. That’s why it also wouldn’t be surprising if a similar approach proved necessary here, as well.
