Nico Gallegos, Joseph Lozano Alleged Drunk Driver Accident in Houston, TX

It appears that 32-year-old Joseph Lozano and 25-year-old Nico Gallegos were in a Ford pickup going southbound on Brittmoore. Another vehicle reportedly made a u-turn and crashed into the Ford, then fled the scene. Both Lozano and Gallegos were injured. The runaway driver appears to have been identified and charges, and details suggest authorities believe that driver was under the influence of alcohol.

Commentary by Attorney Michael Grossman

If it’s true alcohol was a factor here, it wouldn’t really be that unusual. It’s a common reason people flee accident scenes, so the same could be true here. But just because that driver may be facing charges doesn’t make things open-and-shut. That’s especially true when alcohol is involved.

For example, let’s say that a driver who flees an accident scene turns out to be drunk. If they had been drinking at a bar, investigations could reveal that the bar unlawfully over-served the driver. That could then mean the bar is also responsible for contributing to the victims’ injuries, which would require actions completely independent of authorities filing charges against the drunk driver.

Maybe that isn’t what happened here, but that’s why it’s important to know all of the facts. This could all be one reckless individual, or it could be a complex series of events with more than one wrongdoer. In the end, making sure all parties are held appropriately accountable requires evidence. It’s not clear right now if that’s something authorities have been focused on getting.
